Terms and Conditions

These Terms and Conditions govern entry to Gate43 events and the purchase and use of tickets, table reservations and related services offered by Gate43 GmbH. They are governed by Swiss law. By completing an online purchase, the customer confirms that they had the opportunity to review and accept the applicable terms before submitting the order.

Admission
Unless specifically stated otherwise for an event, admission to Gate43 is restricted to guests aged 18 or older. A valid official photo-identification document may be required. Possession of a ticket does not exempt guests from applicable law, safety requirements or Gate43 house rules.
Gate43 may refuse admission or require a guest to leave where justified by safety, security, capacity, intoxication, threatening or inappropriate behaviour, breach of house rules or other legitimate operational reasons, subject to applicable law.
Tickets
Tickets are valid only for the event, date and ticket category shown on the ticket and, unless stated otherwise, grant one entry.
Tickets and QR codes must not be duplicated, manipulated or fraudulently reproduced. Where the same ticket or QR code is presented more than once, only the first valid successful scan may be accepted.
Unauthorised commercial resale and resale above the original face value are not permitted.
Gate43 may verify ticket, booking and, where appropriate, identity information for admission and fraud-prevention purposes.
Orders and Contract Formation
Before submitting an online order, customers must be able to review the relevant order information and correct input errors. The checkout process must clearly identify the action that submits the binding order. After the order is submitted, the customer receives an electronic order or booking confirmation.
Prices and Payment
Unless stated otherwise, prices are displayed in Swiss francs (CHF) and include applicable taxes. The total amount payable is displayed before the order is submitted. Payments may be processed by an external payment provider. A booking is treated as successfully paid only after the relevant payment has been successfully processed and confirmed.
Ticket Cancellations and Refunds
Swiss law does not provide a general statutory right to cancel an ordinary online purchase simply because the customer changes their mind. Any cancellation, refund, credit or transfer option offered by Gate43 is therefore subject to the conditions stated for the relevant event or booking, without affecting any mandatory legal rights.
Table Reservations
A table reservation is confirmed only after the required deposit or other required table payment has been successfully paid.
A generated table-payment link is valid for 30 minutes unless a different period is expressly stated. If payment is not completed within that period, the temporary hold may expire automatically and the table may become available again.
The deposit is credited toward the final table consumption or remaining table balance, unless the specific booking expressly states otherwise.
For a cancellation made more than 48 hours before the event, Gate43 may provide either a refund or a Gate43 credit, as determined for the relevant reservation and subject to any mandatory legal rights.
For a cancellation within 48 hours before the event, or in the event of a no-show, the table deposit is non-refundable to the extent permitted by law.
A table reservation does not by itself grant entry to the event. Unless the specific booking expressly includes event admission, every guest must hold a valid individual event ticket.
The stated maximum capacity of the reserved table may not be exceeded.
Changes to a table reservation are subject to availability and Gate43 confirmation.
If the party has not arrived within 60 minutes after the scheduled reservation time and has not informed Gate43 of the delay, Gate43 may release the table. Guests expecting a later arrival should contact Gate43 in advance. Where operationally possible, Gate43 may keep the table longer at its discretion.
Event Changes, Postponement and Cancellation
Artists, line-ups, running orders, opening times and programme details may change where reasonably necessary. If an event is postponed, cancelled or materially changed, Gate43 will communicate the applicable ticket or booking options in accordance with the circumstances and any mandatory legal requirements.
Photography and Video
Photography and video recording may take place at Gate43 events for documentation, security, communication and promotional purposes. Gate43 will handle identifiable recordings in accordance with applicable law. Where consent is legally required for a specific identifiable use, Gate43 will obtain it as appropriate. Guests with specific concerns may contact Gate43 staff.
Personal Belongings
Guests remain responsible for their personal belongings. To the extent permitted by applicable law, Gate43 is not responsible for loss, theft or damage to personal property unless liability results from conduct for which liability cannot legally be excluded.
Conduct and Safety
Guests must follow reasonable instructions from Gate43 staff and security personnel and comply with applicable house, safety and emergency rules. Violence, threats, harassment, weapons, illegal substances or other conduct that endangers guests, staff or the venue may result in refusal of entry or removal and, where appropriate, notification of the authorities.
Liability
Gate43's liability is governed by applicable Swiss law. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.
Governing Law and Jurisdiction
These Terms are governed by Swiss law. Subject to mandatory legal provisions, the competent courts at the registered office of Gate43 GmbH shall have jurisdiction. Any mandatory consumer jurisdiction rights remain unaffected.
